Letter to Ephesians: Birthright citizenship supporters may get the law wrong by ignoring evidence 14th Amend did NOT include illegal alien babes but opponents ignore at their peril evidence that progressives have always waged a relentless PR campaign to rewrite it in our brains.
Can anyone read an historical map that showed California, Texas & most of what is now the USA’s Southwest was once owned by Mexico, which even tried to militarily stop the Lewis & Clark Expedition from exploring what is now our Northwest? Ever since, despite integration into American culture, many in the Hispanic community have naturally seen itself as deserving if not legally having special treatment, rights & privileges, including the idea that anyone born simply by crossing the US/Mexican border right before birth is automatically a US citizen. The “plain language” of the Civil War era’s 14th Amendment has always been cited as the key … and other ethic groups emigrating to the US since have joined in that “plain language” theory. Together, they’ve convinced the government & jurists to embrace it for nearly 140 years.
Fox News’ Mark Levin & an increasing number of academics, however, have emerged to argue to argue there’s nothing “plain” or conclusive about the 14th Amendment that proves Congress meant for it to be interpreted so as to ignore the legal status of the parents … so that even offspring of sworn enemies (ISIS?) of the Republic should “naturally” be US citizens. Reviews of such Common Law as well as common sense has been cited by such honored jurists as Blackstone & Story suggesting we’ve gotten it all wrong all this time. Congress’ Civil Rights Act of 1866 DID define the limits of birthright citizenship and, Hola, it expressly acknowledged citizenship only of persons born in the US who are “not subject to any foreign power.” The point is: If the historical ruse underpinning the Birthright Citizenship argument is going to be overcome in the case soon to be decided by the Supreme Court, the Justices are going to have to be also convinced of how its made up scope got embedded in the nation’s psyche.
