Birthright Citizenship Case Heads to Supremes

Letters to Ephesians: Supremes agree to hear Trump’s appeal of lower court blocking his denial of “birthright citizenship” to offspring of illegal aliens or temporary foreign visitors. 14th Amend meant to guarantee citizenship for freed slave kids or today’s line jumpers too?

 

The WSJ coverage suggests No. 47’s arguments to limit the post-Civil War 14th Amendment via executive order faces an uphill battle since birthright citizenship challenges since have almost always been decided in favor of the wanna-be citizens. Yet, as noted, “It will be the second time the Supreme Court has considered litigation over the birthright citizenship order. In June, the court’s conservative majority limited the power of lower-court judges to issue nationwide injunctions after the Trump administration challenged the scope of rulings blocking the president’s order.” Yet, in this follow up case the different if related issue is whether a president can deny citizenship to children born on US soil if neither parent is a US citizen or permanent legal resident.

 

As the ACLU and several trial judges have argued, the 14thAmendment has always been construed to grant citizenship at birth to all but the children of foreign diplomats & foreign military forces in the US. But, as the Solicitor General is now countering, the 14thAmendment was meant to right the wrongs of slavery, not encourage thousands if not millions of foreigners to sneek into the US unlawfully and/or time a pregnancy to coincide with a quick visit to California so the new born instantly becomes a citizen. The case is expected to be argued this coming spring & decided by the July 4th holiday.
