Letter to Romans: Reviled by many black & white Dems when nominated for US Sup Ct at 43, 77-yr-old Justice Clarence Thomas is now its 2d longest serving member … brilliantly & long enough to remake American law with his originalist view of the Constitution.
The WSJ’s editors couldn’t help “congratulating” this history-making legal warrior after he earned his revenge against the progressive detractors: “This wasn’t what most legal experts expected when President Bush elevated Judge Thomas from the DC Circuit Court of Appeals in 1991, no less, replacing the deified Thurgood Marshall. It was a time when the High Court tilted left & tried to sell America on its “living Constitution” mantra to rewrite history as if the Founding Fathers never existed. “The left tried to destroy [Thomas] personally at his confirmation hearing, but the Judge memorably fought back & gained his seat.” Not only that, but his originalist view of the Constitution is now firmly in the majority.
Explains the editors: “The latest example arrived last week in the voting-rights case, Louisiana v Callais.” They recalled Thomas’ famous dissenting voice in a 1986 ruling that had paved the way for ever-increasing racial gerrymandering. He presciently opined: “Few devices could be better designed to exacerbate racial tensions than the consciously segregated districting system currently being constructed in the name of the Voting Rights Act … Our drive to segregate political districts by race can only serve to deepen racial divisions by destroying any need for voters or candidates to build bridges between racial groups or to form voting coalitions.” The editors hailed how “last week [Justice Thomas’] ship came in … as the 6-3 majority opinion” in Callais “declared racial gerrymanders to be illegal in all but the rarest circumstances.” Assuming this legal giant stays on the Court until May 20, 2028, he’d pass Justice William Douglas & have “more opportunities to restore the Constitution’s proper understanding.
