Dems’ Gifted Indy Agencies’ End Is Nigh?

Letter to Ephesians: Independent agencies are a Constitutional abortion after being ok’d by the Supreme Court in 1935. Common sense also says a president has the right to fire any appointed executive branch official or bureaucrat. Will today’s Supremes agree, despite Dem opposition?

 

The WSJ’s editorial board thinks so since so-called “Independent Agencies” are a figment of Woodrow Wilson’s hatred of the Constitution’s Separation of Powers Clause and are “politically corrosive” in giving unfettered discretion to a King-like bureaucrat. They explained: “Ninety years ago, a unanimous Supreme Court blessed what has become effectively a fourth branch of government – the unaccountable bureaucracy in Washington today is dotted with stone headquarters for ‘independent’ agencies, where government workers make regulations & enforce laws, insulated from voters & democracy.”

 

Fortunately, the editors noted, the Justices on Monday will consider whether & how to rectify that “historic mistake” when it hears argument in Trump v Slaughter; the key Q being, “Can President Trump fire members of the Federal Trade Commission at will?” As the newspaper says, “The Constitutional answer is yes, there is no fourth branch of government.” But, as too often is the case, the “trickier problem will be mopping up 90 years of a Progressive Era mess.” My two cents: The Democrats in Congress, e.g., like the idea of an “expert class” of bureaucrats calling the shots because nearly all the “experts” in the nation’s “Independent Agencies” are Democrats controlled, either emotionally or via stupidity, by the political party. But fortunately, it’s beginning to look a lot like the Founding Father’s vision will returned to us as a present by a Supreme majority shortly after Christmas this year.
