Justice Jackson’s Blood Rises in Low Blows

Letter to Ephesians: Privileged Justice Jackson descended into child-like whining in scathing dissent involving NIH funding cancellations. She accuses colleagues of ensuring that “Trump always wins.” Time to grow up or resign if she can’t stand something called the Rule of Law?


The Biden-appointee's constant inability to even consider that she may be WRONG occasionally on interpreting the law is getting as old as Learned Hand (if he were still alive). The latest outburst as related by Fox News appears to have something to do with her horror over President Trump’s efforts to end woke black holes getting millions in taxpayer funding and especially the way it may “threaten biomedical research”. The short of it is, a 5-4 majority of Justices ruled that a POTUS DOES have the power to cancel $783 million in NIH grants involving programs that run counter to its priorities. Not mentioned by Jackson was that a 5-4 majority also ruled that the Administration’s ability to cancel such NIH grants in the future might not be so easy or even possible. The reason for the split rulings was over the legal concept of “jurisdiction", i.e., whether such cases over federal funding should be decided in a federal court or the federal Court of Claims. Whatever. But the critical legal distinction seems to have been waived away by Jackson who, instead, accuses her colleagues of “making up the law” so that it always helps ... TRUMP.


Good grief. As GW University Professor Turley observed in a Fox News op ed recently, there’s been a distressing but consistent “rise in ‘rhetoric’ from Jackson, who garnered a reputation as the most vocal justice during oral arguments upon her ascension to the high court.” Unfortunately for Jackson, however, the only “rise” she’s getting is in her blood pressure.
