Justice Sotomayor Is Queen of ID Law

Letter to Romans: Liberal Justice Sonia Sotomayor recently mocked Justice Brett Kavanaugh for having grown up with a silver spoon in his mouth & not having “empathy” for poor migrants. Even if true, what does THAT have to do with interpreting immigration or any other law?

More pointedly, Justice Sotomayor had told college kids her colleague “probably doesn’t really know any person who works by the hour.” The wise crack shocked the WSJ’s editorial board when itself opined: “President Obama pledged to nominate jurists with empathy, and his first pick for the Supreme Court … famously said in a 2001 speech she hoped ‘a wise Latina woman’ would produce better judicial outcomes than ‘a white male who hasn’t lived that life.’ This week we learned what she meant.” What triggered Sotomayor was a Court decision last year focusing on federal agents needing “reasonable suspicion” before questioning a possible illegal alien. The wise crack: “I had a colleague in that case [aka Kavanaugh] who wrote, you know, these are only temporary stops … This is from a man whose parents were professionals .. And probably doesn’t really know any person who works by the hour.” She ranted on about how officers stopping brown people for no other reason robs them of “hours” they could use putting food on the table “for him & his kids …”

Replied the editors: “While that’s empathetic, what does it have to do with the law?” In this case, a federal judge had ordered all inquiring immigration agents to NEVER take into consideration a combination of a suspect’s apparent race or ethnicity; foreign language or accented English; presence at a particular place; or type of work. All Justice Kavanaugh had written in his opinion was to point out “Under this Court’s precedents, not to mention common sense, those circumstances taken together can constitute at least reasonable suspicion of illegal presence … [although] apparent ethnicity alone cannot.” BTW: The majority overruled the rogue federal judge & THAT’s what angered Sotomayor.
