Legal experts say Alec Baldwin is “inseparable” from the “Rust” shooting as he’s sued for wrongful death so a settlement is likely … yet, that script depends on actor’s upcoming motions to dismiss & summary judgment on grounds he had no proven skin or brains in the tragedy.
As Fox News reports, “Baldwin, 63, and others were named in a wrongful death lawsuit filed by cinematographer Halyna Hutchins’ family Tuesday” in connections with Hutchins’ death on the set of “Rust” on Oct. 21 “after a gun Baldwin was holding discharged”. As one lawyer not a part of the lawsuit explained, it’s “almost inescapable” that the actor-producer-shooter will be tied to “any negligence or recklessness shown on the set … if not legally, then, professionally & reputationally.” That being true, he noted, the vast majority of such cases are “settled” prior to trial, one way or another.
But, not mentioned is Baldwin’s insistence he did nothing wrong; really, it was all a pure accident that would have happened to anyone in his situation. No negligence or recklessness on HIS part can be inferred or implied, Baldwin suggests, when OTHERS were clearly negligent or reckless. If he holds to that excuse-making line of reasoning, watch for Baldwin’s lawyers to move the court to dismiss the lawsuit against him “for failure to state a claim upon which relief can be granted,” &/or ask it to declare a “summary judgment” in his favor since, when all of the facts are essentially agreed to, any Hollywood elitist would agree Alec had no culpability, no responsibility, no brains when he held that gun.
