Did Supremes Get Blinded By Pot’s Smoke?

Letter to Romans: It seems even the Supremes are addicted to talking about pot but averse to doing so with clarity. Case in point is the High Court’s recent “unanimous” but fractured decision to ok pot users’ right to bear arms …

The WSJ’s editorial board also noted the US Supreme Court’s over verbose ruling in US v Hemani giving a 9-0 Second Amendment win to a consistent marijuana user: “The rollicking [majority] opinion by Justice Neil Gorsuch, at 19 pages, is worth a read. Yet it provides [only a] few hints of how to draw the line in tougher cases.” The lingering confusion, the editors suggest, stems from the lingering reality that federal law still bans firearm possession by an “unlawful user” of any controlled substance, and btw, marijuana possession is still illegal as a “controlled substance” under US law. Get that? Every one of the Justices struggled in justifying their overriding agreement that pot users CAN generally own guns, despite that legal “technicality???”

The debate among the Justices even spent much time on how much time the Founding Fathers imbibed in booze whether they might be classified as “Habitual drunkards” who might be denied a fire arm if the law could show they had a serious lack of self-control or inability to manage their affairs. Get it? I don’t. Neither did the WSJ. Justices Alito & Kagan, the editors noted, opted out of Gorsuch’s opinion & in a concurrence wished for a narrower ruling with less verbiage. Justices Jackson & Sotomayor “spent 5 pages of their own trashing the existing but contrarian precedents. Yet it was Justice Thomas who wrote solo that the Constitution’s Commerce Clause doesn’t give Congress the power to “regulate the possession of every thing that ever travelled across state lines.” The WSJ asked, “Can we get his colleagues to try whatever Justice Thomas is smoking?” I ask, can we get all 9 Justices to “come out of the weed(s)” & just give us a unified, manageable, clear-eyed ruling to the effect anyone who’s lost their mind shouldn't be allowed to own a gun?
