Fauci Took the 5th But Capone (Sort of) Never Did

Letter to Romans: Mobster Capone never took the 5^th  before Congress, yet the IRS's Frank Wilson (helped by Ness) collared Chicago’s most famous son. The Swamp’s Dr. Fauci refused to sing before Sen. Paul’s Cte yet may escape jail, unless a clever Fed makes him swing ala Capone’s IRS.

Of course, the reason Fauci took the 5^th 112 times as advised by counsel, despite having a prophylactic presidential pardon in his pocket, was the fear he’d have to lie (again) to Congress & the American people if he told the whole truth for once. And that would open him up to criminal perjury charges. That presidential pardon via “autopen” from a supposedly dithering Biden may yet be pierced by a court, but it’s a long haul to the Supreme Court & unlikely of success. True, Fauci’s now facing Paul’s “Contempt of Congress” referral to the DOJ. And that prosecutorial tactic might have a better chance of sticking considering Biden’s pardon gave him all the legal protection he needed to testify safely. But the case law on such contempt proceedings (like the autopen pardon) is “unsettled” while the potential penalties is far less than perjury. Then, again, state prosecutors & “victims” won’t be stopped from levelling criminal & civil charges.

While that’s a lot of “ifs,” Fauci would be advised to keep what one senator called his “dirt bag” lawyer on retainer. That attorney undoubtedly read about the 1950s congressional hearings investigating organized crime after the IRS nailed Capone on income tax evasion & before he died in jail in 1947. So much for Ness’s attempt to get him on his many alleged murders, although he did disrupt much of Al's bootlegging operations. Still, Capone’s ex-inner circle … including his former lawyer, Gus Alex ... would repeatedly invoke the 5^th ala Fauci when appearing before the Kefauver & McClellan Senate Ctes. Oh, Capone had pleaded the 5th during IRS audits, but the Supremes in their 1927 US v Sullivan opinion had already ruled the 5^thAmendment doesn’t protect a tax deadbeat from a tax evasion rap based on illegal gains. What, if anything, will turn out to be Fauci’s legally lethal virus?
