Texas Law Disarms Drag Queen Mommas?

Letter to Philippians: Did a 5th Cir panel correctly ignore worries that a new ban on “prurient” drag shows in front of minors could affect “ballet artists” & pro wresters? Well, if ballerinas & wresters are performing oral sex & buggery moves for kids shouldn’t they be arrested?

 

According to Fox News coverage, plaintiffs & progressive groups like the Civil Liberties Union have voiced concerns that the new Texas law is unconstitutionally “vague,” in part, because it criminalized “prurient” conduct. That First Amendment argument might hold some water before the US Supreme Court in the future, although that term is a word of constitutional art the Justices themselves have used in the past. And the judges did not rule that all drag shows are proscribed, only that they were drawing the line at “sexually explicit” conduct in public while minors are present. Wearing certain prosthetics while doing so appears to be a particular target of the law. For instance, the panel that included judges appointed by Trump & Bush, emphasized evidence showing “one performance where a drag queen, who was wearing a ‘very revealing’ breastplate, pulsed the breastplate in front of people [including children] & put [it] in people’s faces.”

 

Meanwhile, Fox noted, “Business owners could face a $10,000 fine for hosting such performances & performers who violate the law could be slapped with a Class A misdemeanor.”
