Bold Boulder Unmasked: Green Lawfare for All
Letter to Romans: Liberal MSM is portraying Supreme Court’s Suncor v Boulder as “attempt by oil companies to block” local liability suits over alleged global warming damages.” BUT WSJ says “Boulder Gave Away Its Climate Game” aka Green Lawfare for All …
You’ve heard of the Progressive Left’s bankrupting Obamacare II aka “Medicare for All.” Never mind it alone would increase the national debt by TRILLIONS of dollars while making health care coverage worse than ever. Yet, the spendthrifts’ green wing doesn’t blink, the paper’s editorial board opined, when they told the Justices with a straight face that climate change is the oil companies’ fault. Full Stop. Marveled the editors: “There’s no limiting [Constitutional] principle” on supposed [local] harm from C02 emissions, even if that unproven harm happened in Bagdad. Cities like Boulder & states like Colorado can sue & collect billions, although the bill would obviously be passed on to CONSUMERS. Dozens of other states & localities, the WSJ notes, have already filed similar suits in state courts to get in on the haul, which, “as Justice Brett Kavanaugh pointed out, could bankrupt the companies."
A couple of excerpts from the oral arguments on Monday are revealing enough, the paper says: Boulder County attorney Kevin Russel “argued that the lawsuit is a run-of-the-mill tort. Several Justices sounded skeptical. ‘Is there anything anomalous in your mind to applying state laws here to worldwide conduct?’ Justice Gorsuch asked. ‘No, I don’t think so,’ Russell replied, but comparing Boulder’s claims to a product liability lawsuit against an auto maker for a defective car.’ This is an odd analogy since the county isn’t arguing that oil is defective. Far from it. Oil is vital to the economy & everyday living & Boulder County hasn’t sought to ban it. Product liability suits also require plaintiffs to show they have suffered direct harm as a result of a particular defendant’s products. Boulder hasn’t done so.” Then, Justice Clarence wondered if there was any oil company Boulder couldn’t sue on the assumption its oil was causing global warming. Russell said there was nothing in the US Constitution or federal law saying otherwise. ‘So you could just as easily sue large retailers of these {oil] products?’ Thomas asked. Russell agreed.” Got it. If true, Costco & Walmart let alone Amazon better get their wallets out & bend over to take a swift kick from the biggest plaintiffs’ bar sham of all time. Even bigger than doomsday global warming science.
